I am directed to refer to the Government’s decision regarding pension/family pension of all pre-2006 pensioners/family pensioners issued vide Department of Pension and Pensioner’s Welfare O.M. No. 38/37/08-P&PW(A) dated 1.9.2008. In this connection a question has arisen about the Pay Band applicable to pre-2006 pensioners in Central Universities/colleges who had retired from the posts in the pre-revised scale of pay of Rs 1200-420-18300 (or corresponding pay scales applicable prior to 1.1.1996) mentioned below to determine their pension/family pension in terms of para 4.2 of Ministry of Personnel, Public Grievances and Pensions (Department of Pension and Pensioners’ Welfare) O. M. No. 38/37/08-P&W(A) dated 1.9.2008.

2. According to the revised pay scales applicable to Teachers/Equivalent Cadres in Central Universities/Colleges as notified vide Ministry’s letter No. 1-32/2006-U.II/U.I(i) dated 31.12.2008, incumbents of the post mentioned at categories (A) and (B) above who had completed 3 years of service in the pay scale of Rs. 1200-420-18300 on 1.1 2006 have been placed in Pay Band of Rs. 37400-6700 with Academic Grade Pay (AGP) of Rs. 9000. Similarly, in terms of this Ministry’s letter No. 1-32/2006U.II/U.I(ii) dated 31.12.2008, incumbents of the posts of Deputy Registrars/Deputy Finance Officers, Deputy Controllers of Examinations were placed in Pay Band of Rs. 37400-6700 with Grade Pay (GP)of Rs. 8700.


3. Accordingly, the Government has decided that in the case of teachers and equivalent cadres, the pre-2006 pensioners mentioned at categories (A) and (B) above who had completed 3 years of service in the pre-revised pay scale of Rs. 1200-420-18300 (and/or the corresponding scale(s) applicable prior to 1.1.2006) shall be placed at the minimum of the Pay Band of Rs. 37400-6700 with AGP of Rs. 9000, for the revision of their pension/family pension with effect from 1.1.2006. Similarly, in the case of non-teaching posts/cadres, the pre-2006 pensioners mentioned at category (C) above who had completed 5 years of service in the pre-revised pay scale of Rs. 1200-420-18300 (and the corresponding scale(s) applicable prior to 1.1.2006) shall be placed at the minimum of the Pay Band of Rs. 37400-6700 with GP of Rs. 8700, for the revision of their pension/family pension with effect from 1.1.2006. The family pension of these pensioners may be revised accordingly.


4. These orders shall apply to only those pensioners/family pensioners who were drawing pension/family pension on 1.1.2006 under the Central Services (Pension) Rules 1972.


5. This issues with the approval of the competent authority.

OFFICE MEMORANDUM


Subject: Recommendation of 6th Central Pay Commission - Decision of Government relating to grant of Dearness Relief to Central Government pensioners/family pensioners-revised rates effective from 1.1.2006, 1.7.2006, 1.1.2007, 1.7.2007, 1.1.2008 and 1.7.2008

The undersigned is directed to say that consequent upon the decision taken by the Government on the recommendation of 6th Central Pay Commission relating to Dearness Relief, the President is pleased to decide that the Dearness Relief admissible to all categories of Central government pensioners/family pensioners shall be admissible from the dates mentioned below at the rates:-

Note: Dearness relief at the rates indicated in above table will also be admissible on the additional basic pension/additional family pension available to older pensioners/family pensioners based on their age as indicated in this Department's OM. No.38/37/08-P&PW(A) dated 1.9.2008 and 2.9.2008.

2. The payment of Dearness Relief under these orders from the dates indicated above shall be made after adjusting the instalments of enhanced Dearness Relief already sanctioned and paid to Central Government pensioners/family pensioners w.e.f. 1.1.2006 vide OM. No. 42/2/2006 P&PW(G) dated 5.4.2006, w.e.f. 1.7.2006 vide OM.No.42/2/2006 P&PW(G) dated 15.9.2006, w.e.f 1.7.2007 vide OM. No. 42/2/2007 P&PW(G) dated 29.3.2007, w.e.f. 1.7.2007 vide OM.No.42/2/2007 P&PW(G) dated 18.9.2007 and w.e.f 1.1.2008 vide OM.No.42/2/2008 P&PW(G) dated 19.3.2008.

3. These orders apply to (i) All Civilian Central Government Pensioners/Family Pensioners (ii) The Armed Forces Pensioners/Family pensioners, Civilian Pensioners/family pensioners and paid out of the Defence Service Estimates, (iii) All India Service pensioners/family pensioners (iv) Railway pensioners/family pensioners and (v) The Burma Civilian pensioners/Family pensioners and pensioners/families of displaced Government pensioners from Pakistan, who are Indian Nationals but receiving pension/family pension on behalf of Government of Pakistan, who are in receipt of Ad-hoc ex-gratia allowance of Rs.1275/- p.m. in terms of this Department's OM.No.23/1/97-P&PW(B) dated 23.2.1998.

4. Central Government employees who had drawn lumpsum amount on absorption in a PSU/Autonomous Body and have become eligible for the restoration of 1/3rd commuted pension of pension as well as revision of the restored amount in terms of this Department's OM.NO.4/59/97-P&PW (D) dated 14.7.1998 will also be entitled to the payment of revised rates as per the table given above of Dearness Relief w.e.f. 1.1.2006 on the full pension/family pension i.e. the revised pension/family pension which the absorbed employee would have received on the date of restoration had he not drawn lumpsum payment on absorption and Dearness pension subject to fulfillment of the conditions laid down in para 5 of the OM dated 14.7.1998. In this connection instructions contained in this Department's OM.No.4/29/99 P&PW (D) dated 12.7.2000, O.M.No.4/31/2000-P&PW(D) dated 16.1.2001 and OM.No.4/79/2006-P&PW(D) dated 6.9.2007 and OM.No.4/38/2008 P&PW(D) dated 12.9.2008, may be referred.

5. The other categories of CPF beneficiaries, their widows and diseased children who are in receipt of ex-gratia payment in terms of this Department's OM.No.45/52/97 P&PW(E) dated 16.12.1997 will continue to be governed by the said OM.

6. Payment of DR involving a fraction of a rupee shall be rounded off to the next higher rupee.

7. Other provisions governing grant of DR in respect of employed family pensioners and re-employed Central Government Pensioners will be regulated in accordance with the provisions contained in this Department's OM.No.45/73/97-P&PW (G) dated 2.7.1999. The provisions relating to regulation of DR where pensioner is in receipt of more than one pension will remain unchanged.

8. In the case of retired Supreme Court and High Court Judges necessary order will be issued by the Department of Justice separately.

9. It will be the responsibility of the pension disbursing authority, including the nationalized banks, etc. to calculate the quantum of DR payable in each individual case.

10. The officers of Accountant General and Authorized Public Sector Banks are requested to arrange payment of relief to pensioners etc. on the basis of above instructions without waiting for any further instructions from the Comptrollers and Auditor General of India and the Reserve Bank of India in view of letter No. 528-TA, II/34-80-II dated 23.4.1981 of the Comptroller and Auditor General of India addressed to all Accountant Generals and Reserve Bank of India Circular No. GANB No.2958/GA-64 (ii) (CGL)/81 dated the 21st May, 1981 addressed to State Bank of India and its subsidiaries and all Nationalized Banks.

11. In their application to the pensioners/family pensioners belonging to Indian Audit and Accounts Department these orders issue in consultation with the C&AG.

12. The issues with the concurrence of Ministry of Finance, Department of Expenditure vide their UO.No.1(4)ev/2004 dated 9.9.2008.

(ii) The Fitment Tables (Table No. 1 to 6) for fixation of pay of the existing incumbents, who are in position as on 1.1.2006. in various categories of posts as indicated in the Tables, are appended to this communication as Annexure-I.
(iii) The payment will be made after taking an undertaking from the existing incumbents to the effect that the excess amount, if any, made on incorrect fixation of pay in the pay band or AGP, shall be adjusted against the future payments due. (iv) The pay in the revised scales shall be payable in cash with effect from 1st August,2009. The arrears for the period from 1st January,2006 to 31st July,2009 would be released in instalments in due course.
2. The revised scales are applicable to the teachers and equivalent cadres of the Universities (including Panjab University, Chandigarh), Government Colleges, Government Aided Private Colleges, and the Directorate of Colleges only. A Committee has been constituted to consider the other recommendations/ benefits/allowances mentioned in Notification of 6th Pay Commission issued by Government of India, Ministry of Human Resource Development vide
No. 1-32/2006FUII/UI(i) dated 31.12.2008. The necessary action will be taken as and when the recommendations of this Committee will be received.
3. The Revised Pay Scales, Pay Structure, Eligibility, Career Advancement Scheme and Service conditions are appended to this communication as Annexure II. The relevant rules for fixation as per Sixth Central Pay Commission formula are given as Annexure III.
4. The allowances admissible to Punjab Government employees as applicable to the personnel covered under this notification will be payable at the rates notified by Punjab Government from time to time and with effect from the dates applicable to other Punjab Government employees.
5. The revised pay scales are applicable to the teachers and equivalent cadres of Universities (including Panjab University, Chandigarh) Government Colleges, Government Aided Private Colleges, and the Directorate of Colleges only.
6. The revised pay scales are not applicable in the case of Punjab Agriculture University, Ludhiana, Guru Angad Dev University of Animal Husbandry & Veterinary Science, Ludhiana, and Medical, Veterinary Science, Technical and Engineering Universities and Colleges.
7. Necessary amendments in the statutes, rules and regulations, etc. of the concerned Universities, and amendments in the Punjab Educational Service (College Cadre) Class-I and Class-II Rules, 1976 will be made by the concerned University/ State Government where called for.
8. Other terms and conditions of service of teachers shall be the same as may be notified by the State Govt. or specified by way of Regulations incorporating the approved pay scales and other related conditions by the Universities/State Govt. on the lines of existing scheme(s).
9. The above scheme will be applicable subject to the acceptance of all the conditions mentioned in their letter by the Govt. of India, Ministry of Human Resources Development
10. Regular and systematic appraisal of performance of teachers is to be an essential element in the management of education and this has been taken into account in the designing for the carer development of teachers. Till the State Government formulates the guidelines for evaluation of performance of teachers, as per policy to be framed by the UGC and become operative the existing screening mechanism/selection procedure prescribed by the Universities concerned/State Government will apply to all placements/promotions.
11. All teachers and equivalent cadres shall observe the code of professional ethics recommended by the UGC and as laid down by the State Govt.
12. The above conditions will apply to all teachers and equivalent cadres appointed on or after the date of issue of this notification. These conditions will also apply to existing incumbents along with modifications specified above.
13. All other service conditions of University and College teachers and equivalent cadres will continue to be governed by existing rules/instructions of the State Govt.
14. The State Govt. may change any of the above conditions of its own or on the recommendations of the UGC/Government of India.

Annexure-II
(Revised pay scale, pay structure, eligibility, career advancement scheme and service conditions).
1. General
(i) There shall be only three designations in respect of teachers in universities and colleges, namely, Assistant Professors, Associate Professors and Professors. However, there shall be no change in the present designation in respect of Library and Physical Education Personnel at various levels.
(ii) No one shall be eligible to be appointed, promoted or designated as Professor, unless he or she possesses a Ph.D. and satisfies other academic conditions, as laid down by the University Grants Commission (UGC) from time to time. This shall, however, not affect those who are already designated as „Professor‟.
(iii) The pay of teachers and equivalent positions in Universities and Colleges shall be fixed according to their designations in two pay bands of Rs. 15600-39100 and Rs. 37400-67000 with appropriate “Academic Grade Pay” (AGP in short). Each Pay Band shall have different stages of Academic Grade Pay which shall ensure that teachers and other equivalent cadres covered under this Scheme, subject to other conditions of eligibility being satisfied, have multiple opportunities for upward movement during their career.
(iv) Posts of Professors shall be created in under-graduate (UG) colleges as well as in post-graduate (PG) colleges. The number of posts of Professors in a UG College shall be equivalent to 10 percent of the number of posts of Associate Professors in that College. There shall be as many posts of Professors in each PG College as the number of Departments in that College. No new Departments shall be created in UG or PG Colleges without prior approval of the UGC.
(v) Up to 10% of the posts of Professors in universities shall be in the higher Academic Grade Pay of Rs. 12000 with eligibility conditions to be prescribed by the UGC.
(vi) National Eligibility Test (NET) shall be compulsory for appointment at the entry level of Assistant Professor, subject to the exemptions to the degree of Ph.D. in respect of those persons obtaining the award through a process of registration, course-work and external evaluation, as have been/ or may be laid down by the UGC through its regulations, and so adopted by the University. NET shall not be required for such Masters‟ programmes in disciplines for which there is no NET.
 
2. Revised Pay Scales, Service conditions and Career Advancement Scheme for teachers and equivalent positions:

The pay structure for different categories of teachers and equivalent positions shall be as indicated below:-
(a) Assistant Professor/Associate Professors/Professors in Colleges & Universities
(i) Persons entering the teaching profession in Universities and Colleges shall be designated as Assistant Professors and shall be placed in the Pay Band of Rs.15600-39100 with AGP of Rs.6000. Lecturers already in service in the pre-revised scale of Rs. 8000-13500, shall be re-designated as Assistant Professors with the said AGP of Rs. 6000.
(ii)An Assistant Professor with completed service of 4 years, possessing Ph.D Degree in the relevant discipline shall be eligible, for moving up to AGP of Rs. 7000.
(iii) Assistant Professors possessing M.Phil degree or post-graduate degree in professional courses approved by the relevant Statutory Body, such as LL.M/M.Tech etc. shall be eligible for the AGP of Rs. 7,000 after completion of 5 years service as Assistant Professor.
(iv) Assistant Professors who do not have Ph.D or M.Phil or a Master‟s degree in the relevant Professional course shall be eligible for the AGP of Rs. 7,000 only after completion of 6 years‟ service as Assistant Professor.
(v) The upward movement from AGP of Rs. 6000 to AGP of Rs. 7000 for all Assistant Professors shall be subject to their satisfying other conditions as laid down by the UGC.
(vi) The pay of the incumbents to the posts of Lecturer (senior scale) (i.e. the un-revised scale of Rs. 10,000-15200) shall be re-designated as Assistant Professor, and shall be fixed at the appropriate stage in Pay Band of Rs.15600-39100 based on their present pay, with AGP of Rs. 7000.
(vii) Assistant Professors with completed service of 5 years at the AGP of Rs. 7000 shall be eligible, subject to other requirements laid down by the UGC, to move up to the AGP of Rs. 8000.
(viii) Posts of Associate Professor shall be in the Pay Band of Rs.37400-67000, with AGP of Rs.9000. Directly recruited Associate Professors shall be placed in the Pay Band of Rs. 37400-67000 with an AGP of Rs. 9000, at the appropriate stage in the Pay Band in terms of the conditions of appointment.
(ix) Incumbent Readers and Lecturers (Selection Grade) who have completed 3 years in the current pay scale of Rs. 12000-18300 on 1.1.2006 shall be placed in Pay Band of Rs. 37400-67000 with AGP Pay of Rs. 9000 and shall be re-designated as Associate Professor.
(x) Incumbent Readers and Lecturers (Selection Grade) who had not completed three years in the pay scale of Rs. 12000-18300 on 1.1.2006 shall be placed at the appropriate stage in the Pay Band of Rs. 15600-39100 with AGP of Rs. 8000 till they complete 3 years of service in the grade of Lecturer (Selection Grade)/Reader, and thereafter shall be placed in the higher Pay Band of Rs.37400-67000 and accordingly re-designated as Associate Professor.
(xi) Readers/ Lecturers (Selection Grade) in service at present shall continue to be designated as Lecturer (Selection Grade) or Readers, as the case may be, until they are placed in the Pay Band of Rs. 37,400-67000 and re-designated as Associate Professor in the manner described in (x) above.
(xii) Assistant Professors completing 3 years of teaching in the AGP of Rs. 8000 shall be eligible, subject to other conditions, that may be prescribed by the UGC and the university, to move to the Pay Band of Rs. 37400-67000 with AGP of Rs. 9000 and to be designated as Associate Professor.
(xiii) Associate Professor completing 3 years of service in the AGP of Rs. 9000 and possessing a Ph.D.degree in the relevant discipline shall be eligible to be appointed and designated as Professor, subject to other conditions of academic performance as laid down by the UGC and if any by the university. No teacher other than those with a Ph.D. shall be promoted, appointed or designated as Professor. The Pay Band for the post of Professors shall be Rs. 37400-67000 with AGP of Rs. 10000.
(xiv) The pay of a directly recruited Professor shall be fixed at a stage not below Rs. 43000 in the Pay Band of Rs. 37400-67000, with the applicable AGP of RS. 10000.
(xv) Ten percent of the posts of Professors in a university shall be in the higher AGP of Rs. 12000, however, teachers appointed to the posts shall continue to be designated as Professor. Eligibility for appointment as a Professor in the higher Academic Grade Pay shall be as may be laid down by the UGC, and such eligibility conditions shall, inter alia, include publications in peer reviewed/ refereed Research Journals, and the requirement of at least 10 years of teaching as Professor and post-doctoral work of a high standard. No person appointed directly as Professor in the AGP of Rs. 12000 shall be fixed at a stage less than Rs. 48000 alongwith the with the AGP.
(xvi) For initial direct recruitment at the level of Associate Professors and Professors, the eligibility conditions in respect of academic and research requirements shall be as may be or have been prescribed by the UGC through Regulations and as may be laid down by the University.
(xvii) Discretionary award of advance increments for those who enter the profession as Associate Professors or Professors with higher merit, high number of research publications and experience at the appropriate level, shall be within the competence of the appropriate authority of the concerned University or recruiting institution while negotiating with individual candidates in the context of the merits of each case, taking into account the pay structure of other teachers in the faculty and other specific factors.
(b) Professors in Under Graduate and Post Graduate Colleges:
(xviii) Ten percent of the number of sanctioned posts of Associate Professor in an Under Graduate College shall be that of Professors and shall be subject to the same criterion for selection/ appointment as that of Professors in Universities, provided that there shall not be more than one post of Professor in each Department; and provided further that One-fourth (25%) of the posts of Professor in UG Colleges shall be directly recruited or filled on deputation by eligible teachers and the remaining three-fourths (75%) of posts of Professors shall be filled by merit promotion from among eligible Associate Professors of the relevant department of the Under Graduate College. Identification of posts of Professor in an Under Graduate College for being filled through direct recruitment/deputation shall be within the competence of the University acting in consultation with the College. Where the number of posts of Professor worked out as a percentage of the number of posts of Associate Professor for merit promotion or direct recruitment/ deputation is not an integer, the same shall be rounded off to the next higher integer.
(xix) There shall be one post of Professor in each Department of a Post Graduate College and shall be subject to the same criterion for selection/ appointment as that of Professors in Universities, provided that One-fourth (25%) of the posts of Professor shall be filled on deputation/direct recruitment from among eligible teachers and the remaining three-fourths (75%) of posts shall be filled through merit promotion from among the eligible Associate Professors in the relevant department of the Post Graduate College. Identification of posts of Professor in a Post Graduate College for being filled through direct recruitment/deputation shall be within the competence of the University acting in consultation with the College. Where the number of posts of professor for merit promotion or direct recruitment/ deputation worked out as a percentage of the total number of posts in a Post Graduate College is not an integer, the same shall be rounded off to the next higher integer. The UGC shall issue separate guidelines to ensure availability of minimum standards of academic infrastructure (library, research facilities etc.) for starting Post Graduate Courses in Colleges.
3. Pay Scales of Pro-Vice Chancellor/Vice Chancellor of Universities:
(i) Pro-Vice-Chancellor. The posts of Pro-Vice Chancellor shall be in the Pay Band of Rs.37400-67000 with AGP of Rs. 10000 or Rs. 12000, as the case may be, along with a Special Allowance of Rs.4000 per month, subject to the condition that the sum total of pay in the Pay Band, the Academic Grade Pay and the Special Allowance shall not exceed Rs. 80,000.
(ii) Vice Chancellor.The posts of Vice Chancellor shall carry a fixed pay of Rs. 75000 along with a Special Allowance of Rs. 5000 per month.
4. Pay Scales of Principals in Colleges:
(i) Principal of Under Graduate Colleges
Appointments to the posts of Principal in Under Graduate Colleges shall be based on the conditions of eligibility in respect of educational qualifications and teaching/research experience laid down by the University Grants Commission and if any by the university from time to time. The posts of Principal in Under Graduate Colleges shall be in the Pay Band of Rs.37400-67000 with AGP of Rs.10000, plus a Special Allowance of Rs. 2000 per month. All Principals in service shall be appropriately fixed in the Pay Band with the AGP of Rs. 10000.
(ii) Principal of Post Graduate Colleges
Appointments to the posts of Principal in Post Graduate Colleges shall be based on the conditions of eligibility in respect of educational qualifications and teaching/research experience laid down by the University Grants Commission and if any by the university from time to time. Posts of Principal in Post Graduate Colleges shall also be in the Pay Band of Rs.37400-67000 with AGP of Rs.10,000, plus a Special Allowance of Rs. 3000 per month. All Principals in service shall be appropriately fixed in the Pay Band with the AGP of Rs. 10000.
5. Pay Scales and Career Advancement Scheme for Librarians etc:
(a) Assistant Librarian/ College Librarian:
(i) Assistant Librarian/ College Librarian in the pre-revised scale of pay of Rs. 8000-13500 shall be placed in the Pay Band of Rs.15600-39100 with AGP of Rs. 6000.
(ii) All existing conditions of eligibility and academic qualifications laid down by the UGC shall continue to be applicable for direct recruitment of Assistant Librarian/ College Librarian.
(b) Assistant Librarian (Sr. Scale)/ College Librarian (Sr.Scale)
(i) The posts of Assistant Librarian (Sr. Scale)/ College Librarian (Sr.Scale) in the pre-revised scale of pay of Rs. 10000-15200 shall be placed in the Pay Band of Rs. 15600-39100 with AGP of Rs.7000.
(ii) Assistant Librarian/ College Librarian possessing Ph.D. in Library Science at the entry level, after completing service of 4 years in the AGP of Rs.6000, and if otherwise eligible as per guidelines laid down by the UGC shall be eligible for the higher AGP of Rs. 7000 with in the Pay Band of Rs. 15600-39100.
(iii) Assistant Librarian/ College Librarian not possessing Ph.D. but only M.Phil in Library Science at the entry level after completing service of 5 years in the AGP of Rs. 6000, if otherwise eligible as per guidelines laid down by the UGC, shall become eligible for the higher AGP of Rs. 7000.
(iv) After completing service of 6 years in the AGP of Rs. 6000 Assistant Librarian/ College Librarian without the relevant Ph.D. and M.Phil shall, if otherwise eligible as per guidelines laid down by the UGC and if any by the university, move to the higher AGP of Rs. 7000.
(v) The pay of the existing Assistant Librarian (Sr. Scale)/ College Librarian (Sr.Scale) in the pre-revised scale of pay of Rs. 10000-15200 shall be fixed in the Pay Band of Rs. 15600-39100 with AGP of Rs. 7000. at an appropriate stage based on their present pay.
(c) Deputy Librarian/ Assistant Librarian (Selection Grade)/College Librarian (Selection Grade)
(i) Deputy Librarians who are directly recruited at present shall be placed in the Pay Band of Rs. 15600-39100 with AGP of Rs. 8000 initially at the time of recruitment.
(ii) On completion of service of 5 years, Assistant Librarian (Sr. Scale)/ College Librarian (Senior Scale) shall be eligible for the post of Deputy Librarian/ equivalent posts in Pay Band of Rs. 15600-39100, with Academic Grade Pay of Rs.8,000, subject to their fulfilling other conditions of eligibility (such as Ph.D. degree or equivalent published work etc. for Deputy Librarian) as laid down by the UGC. They shall be designated as Deputy Librarian/ Assistant Librarian (Selection Grade)/ College Librarian (Selection Grade), as the case may be.
(iii) The existing process of selection by a Selection Committee shall continue in respect of promotion to the post of Deputy Librarian and their equivalent positions.
(iv) After completing 3 years in the Pay Band of Rs. 15600-39100 with an AGP of Rs. 8000, Deputy Librarians/ equivalent positions shall move to the Pay Band of Rs. 37400-67000 and AGP of Rs. 9000, subject to fulfilling other conditions of eligibility laid down by the UGC and if any by the university.
(v) Assistant Librarians ( Senior Scale) in universities/ College Librarians (Senior Scale) in the AGP of Rs.7000 not possessing Ph.D. in Library Science or equivalent published work but who fulfill other criteria prescribed by the UGC and if any by the university, shall also be eligible for being placed in the AGP of Rs. 8000.
(vi) Incumbents to the posts of Deputy Librarian/ Assistant Librarian (Selection Grade)/College Librarian (Selection Grade) who have completed three years in the pre-revised pay scale of Rs. 12000-18300 on 1.1.2006 shall be fixed at an appropriate stage in the Pay Band of Rs. 37400-67000 with an AGP of Rs. 9000. They shall continue to be designated as Deputy Librarian/ Assistant Librarian (Selection Grade)/College Librarian (Selection Grade).
(vii) Incumbents to the posts of Deputy Librarian/ Assistant Librarian (Selection Grade)/College Librarian (Selection Grade) who have not completed the requirement of three years in the pre-revised pay scale of Rs. 12000-18300, for being eligible to be placed in the higher Pay Band of Rs. 37400-67000, shall be placed at an appropriate stage with Academic Grade Pay of Rs.8000 till they complete three years of service as Deputy Librarian/ Assistant Librarian (Selection Grade)/ College Librarian (Selection Grade).
(viii) Pay in regard to the directly recruited Deputy Librarians shall be initially fixed in Pay Band Rs. 15600-39100 with AGP of Rs. 8000. They shall move to the Pay Band of Rs. 37400-67000 with AGP of Rs. 9000 after completing three years of service in the AGP of Rs. 8000.
(ix) The existing conditions of eligibility and academic qualifications prescribed by the UGC shall continue to be applicable for direct recruitment to the post of Deputy Librarian.
(d) Librarian (University)
(i) The post of Librarian shall be in the Pay Band of Rs. 37400-67000 with the Academic Grade Pay of Rs. 10000.
(ii) The existing conditions of eligibility and academic qualifications prescribed by the UGC shall continue to be applicable for appointment to the post of Librarian (University).
(iii) Deputy Librarian completing service of three years in the AGP of Rs. 9000 and otherwise eligible as per conditions prescribed by the UGC and if any by the university, shall also be eligible to be considered for appointment to the post of Librarian through open recruitment.
(iv) Incumbent Librarian (University) shall be placed at the appropriate stage as per the „fixation formula‟ of the 6th CPC in the Pay Band of Rs. 3740-67000 with AGP of Rs. 10000.
6. Pay Scales and Career Advancement Scheme for Physical Education Personnel:
(a) Assistant Director of Physical Education( Assistant DPE)/ College Director of Physical Education (College DPE)
(i) The Assistant Director of Physical Education/ College DPE in the pre-revised pays scale of Rs. 8000-13500 shall be placed in the Pay Band of Rs.15600-39100 with AGP of Rs. 6000.
(ii) Pay of incumbent Assistant Directors of Physical Education/ College DPE shall be fixed at an appropriate stage in the Pay Band of Rs. 15600-39100 with an AGP of Rs. 6000, in accordance with the „fixation formula‟ of the 6th CPC.
(iii) All existing conditions of eligibility and academic qualifications laid down by the UGC shall continue to be applicable for direct recruitment of Assistant Director of Physical Education/College DPE.
(b) Assistant Director of Physical Education (Senior Scale)/ College DPE (Senior Scale)
(i) Assistant Directors of Physical Education (Senior Scale)/ College DPE (Senior Scale) in the pre-revised pay scale of Rs. 10000-15200 shall be placed in the Pay Band of Rs. 15600-39100 with AGP of Rs. 7000.
(ii) Assistant Directors of Physical Education (Senior Scale)/ College DPE (Senior Scale) possessing Ph.D. in Physical Education at the entry level of Assistant DPE/ College DPE in the AGP of Rs. 6000 shall, after completing service of four years in the AGP of Rs.6000, and if otherwise eligible as per guidelines prescribed by the UGC and if any by the university, move to higher AGP of Rs. 7000 in the Pay Band of Rs. 15600-39100.
(iii) Assistant Directors of Physical Education (Senior Scale)/ College DPE (Senior Scale) possessing M.Phil in Physical Education at the entry level of Assistant DPE/ College DPE in the AGP of Rs. 6000 shall, after completing service of five years in the AGP of Rs. 6000, be eligible for the higher AGP of Rs. 7000.
(iv) Assistant Directors of Physical Education/ College DPEs without the relevant Ph.D. and M.Phil shall, after completing service of six years as Assistant Director of Physical Education/College DPE in the AGP of Rs. 6000, and if otherwise eligible as per guidelines prescribed by the UGC and if any by the university, be eligible for being placed in the AGP of Rs. 7000.
(v) Pay of incumbent Assistant Directors of Physical Education (Senior Scale)/ College DPE (Senior Scale) shall be fixed in Pay Band of Rs. 15600-39100 at an appropriate stage in the AGP of Rs. 7000, as per the „fixation formula‟ of the 6th CPC.
(c) Deputy Director of Physical Education/ Assistant Director of Physical Education (Selection Grade)/ College Director of Physical Education (Selection Grade)
(i) After completing service of five years in the Pay Band of Rs. 15600-39100 with the AGP of Rs. 7000 and subject to satisfying other eligibility conditions laid down by the UGC and if any by the university, Assistant Director of Physical Education (Senior Scale)/ College DPE (Senior Scale) shall move to AGP of Rs. 8000 in the Pay Band of Rs. 15600-39100. They shall be designated as Deputy Director of Physical Education/ Assistant DPE (Selection Grade)/ College DPE (Selection Grade), as the case may be.
(ii) After completing service of three years in the Pay Band of Rs. 15600-39100 and the AGP of Rs. 8000 and subject to eligibility laid down by the UGC and if any by the university, Deputy DPE/ Assistant DPE (Selection Grade)/ College DPE (Selection Grade) shall move to the Pay Band of Rs. 37400-67000 with the AGP of Rs. 9000. They shall continue to be designated as Deputy DPE/ Assistant DPE (Selection Grade)/ College DPE (Selection Grade)
(iii) All Incumbents to the post of Deputy DPE/ Assistant DPE (Selection Grade)/ College DPE(Selection Grade) who have completed service of at least three years in the un-revised Pay Scale of Rs. 12000-18300 as on 1.1.2006 shall be eligible to be fixed in the Pay Band of Rs. 37400-67000 with AGP of Rs. 9000.
(iv) All incumbents to the post of Deputy DPE/ Assistant DPE (Selection Grade)/ College DPE (Selection Grade) whose services in the un-revised Pay Scale of Rs. 12000-18300 fall short of three years which would have made them eligible to move to the higher Pay Band, shall be placed at an appropriate stage at the AGP of Rs. 8000 in the Pay Band of Rs. 15600-39100 till they complete the required service of three years as Deputy DPE/ ADPE (Selection Grade)/ College DPE (Selection Grade) in the un-revised Pay Scale. Pay of the directly recruited Deputy DPE shall be initially fixed with the AGP of Rs. 8000 in the Pay Band of Rs. 15600-39100, and after completing 3 years of service directly recruited Deputy DPE and equivalents shall move to Pay Band Rs. 37400-67000 with AGP of Rs. 9000.
(d) Director of Physical Education (University):
(i) Post of Director Physical Education in universities shall be in the Pay Band of Rs. 37400-67000 with AGP of Rs. 10000.
(ii) Post of Director Physical Education (University) shall continue to be filled through direct recruitment and the existing conditions of eligibility i.e. the minimum qualification, number of years of relevant experience and other conditions prescribed by the UGC shall continue to be the eligibility for recruitment.
(iii) Pay of the incumbents shall be fixed at the appropriate stage in the Pay Band of Rs. 37400-67000 as per „fixation formula‟ of the Government of India for 6th CPC.
7. Incentives for Ph. D./M.Phiil and other higher qualification:
(i) Five non-compounded advance increments shall be admissible at the entry level of recruitment as Assistant Professor to persons possessing the degree of Ph.D. awarded in the relevant discipline by a university following the process of registration, coursework and external evaluation as prescribed by the UGC.
(ii) M.Phil degree holders at the time of recruitment to the post of Assistant Professor shall be entitled to two non-compounded advance increments.
(iii) Those possessing Post Graduate degree in a professional course such as LL.M/M.Tech etc., recognized by the relevant Statutory Body/Council, shall also be entitled to 2 non-compounded advance increments at the entry level.
(iv) Teachers who complete their Ph.D. degree while in service shall be entitled to three non-compounded increments if such Ph.D. is in the relevant discipline and has been awarded by a university complying with the process prescribed by the UGC for enrolment, course-work and evaluation etc.
(v) However, teachers in service who have been awarded Ph . D. at the time of coming into force of this Scheme or having been enrolled for Ph.D. have already undergone course-work, if any, as well as evaluation , and only notification in regard to the award of Ph.D. is awaited , shall also be entitled to the award of three non –compounded increments even if the university awarding such Ph.D. has not yet been notified by the UGC as having complied with the process prescribed by the Commission.
(vi) In respect of every other case, a teacher who is already enrolled for Ph.D. shall avail the benefit of three non-compounded increments only if the university awarding the Ph.D. has been notified by the UGC to have complied with the process prescribed by the Commission for the award of Ph.D, in respect of either course-work or evaluation or both, as the case may be.
(vii) Teachers in service who have not yet enrolled for Ph.D. shall therefore derive the benefit of three non-compounded increments on award of Ph.D, while in service only if such enrolment is with a university which complies with the entire process, including that of enrolment as prescribed by the UGC.
(viii) Teachers who acquire M.Phil, degree or a post graduate degree in a professional course recognized by the relevant Statutory Body/Council, while in service, shall been titled to one advance increment . If post graduate qualification in a particular subjects not a mandatory requirement at the entry level of recruitment, acquisition of such a qualification for in service candidates shall also entitle them to one advance increment.
(ix) Five non-compounded advance increments shall be admissible to Assistant Librarian/ College Librarian who are recruited at entry level with Ph.D. degree in the discipline of library science from a university complying with the process prescribed by the UGC in respect of enrolment, course-work and evaluation process for the award of Ph.D. in library science.
(x) Assistant Librarian/ College Librarian and other Library personnel acquiring the degree of Ph.D, at any time while in service, in the discipline of library science from a university complying with the process prescribed by the UGC in respect of enrolment, course-work and evaluation shall be entitled to three non-compounded advance increments.
(xi) However, persons in posts of Assistant Librarian/College Librarian or higher positions who have been awarded Ph.D. in library science at the time of coming into force of this Scheme or having been enrolled for Ph.D. in library science have already undergone course-work , if any, as well as evaluation , and only notification in regard to the award of Ph.D . is awaited, shall also be entitled to the award of three non-compounded increments even if the university awarding such Ph.D. has not yet been notified by the UGC as having complied with the process prescribed by the Commission.
(xii) In respect of every other case of persons in the posts of Assistant Librarian/College Librarian or higher positions who are already enrolled for Ph.D. shall avail the benefit of three non-compounded increments only if the university awarding the Ph.D. has been notified by the UGC to have complied with the process prescribed by the Commission for the award of Ph . D, in respect of either course - work or evaluation or both, as the case may be.
(xiii) Assistant Librarian/ College Librarian and others in higher Library positions in service who have not yet enrolled for Ph.D. shall therefore derive the benefit of three non-compounded increments on award of Ph.D, while in service only if such enrolment is with a university which complies with the entire process, including that of enrolment as prescribed by the UGC.
(xiv) Two non-compounded advance increments shall be admissible for Assistant Librarian/ College Librarian with M.Phil degree in Library Science at the entry level. Assistant Librarian/ College Librarian and those in higher positions acquiring M.Phil degree in Library Science at any time during the course of their service, shall be entitled to one advance increment.
(xv) Five non-compounded advance increments shall be admissible to Assistant Director of Physical Education/ College Director of Physical Education who are recruited at entry level with Ph.D. degree in the discipline of Physical Education from a university complying with the process prescribed by the UGC in respect of enrolment, course-work and evaluation process for the award of Ph.D. in Physical Education.
(xvi) Persons in posts of Assistant Director of Physical Education/ College DPE or higher positions acquiring the degree of Ph.D in the discipline of Physical Education, at any time while in service from a university complying with the process prescribed by the UGC in respect of enrolment, course-work and evaluation shall be entitled to three non-compounded advance increments.
(xvii) However, persons in posts of Assistant Director of Physical Education/ College DPE or higher positions who have been awarded Ph.D. in Physical Education at the time of coming into force of this Scheme or having been enrolled for Ph.D. in Physical Education have already undergone course-work, if any, as well as evaluation, and only notification in regard to the award of Ph.D. is awaited, shall also be entitled to the award of three non-compounded increments even if the university awarding such Ph.D. has not yet been notified by the UGC as having complied with the process prescribed by the Commission.
(xviii) In respect of every other case of persons in the posts of Assistant Director of Physical Education/ College DPE or higher positions who are already enrolled for Ph.D. in Physical Education shall avail the benefit of three non-compounded increments only if the university awarding the Ph.D. has been notified by the UGC to have complied with the process prescribed by the Commission for the award of Ph.D, in respect of either course-work or evaluation or both, as the case may be.
(xix) Assistant Director of Physical Education/ College DPE and others in higher Physical Education positions in service who have not yet enrolled for Ph.D. shall therefore derive the benefit of three non-compounded increments on award of Ph.D, while in service only if such enrolment is with a university which complies with the entire process, including that of enrolment as prescribed by the UGC.
(xx) Two non-compounded advance increments shall be admissible for Assistant Director of Physical Education/ College DPE with M.Phil degree in Physical Education at the entry level. Assistant Director of Physical Education/ College DPE and those in higher positions acquiring MPhil degree in Physical Education at any time during the course of their service, shall be entitled to one advance increment.
(xxi) Not withstanding anything in the foregoing clauses, those who have already availed the benefits of advance increments for possessing Ph.D./ M.Phil. at the entry level under the earlier scheme shall not be entitled to the benefit of advance increments under this Scheme.
(xxii) For posts at the entry level where no such advance increments were admissible for possessing Ph.D/ M.Phil. under the earlier scheme, the benefit of five advance increments for possessing Ph.D./ M.Phil. shall be available to only those appointments which have been made on or after the coming into force of this Scheme.
(xxiii) Teachers, Library and Physical Education cadres who have already availed the benefits of increments as per existing policy for acquiring Ph.D./M.Phil while in service, would not be entitled to benefits under this Scheme.
8. Other terms and conditions:
(a) Increments:
(i) Each annual increment shall be equivalent to 3% of the sum total of pay in the relevant Pay Band and the AGP as applicable for the stage in the Pay Band.
(ii) Each advance increment shall also be at the rate of 3% of the sum total of pay in the relevant Pay Band and the AGP as applicable and shall be non-compoundable.
(iii) The number of additional increment(s) on placement at each higher stage of AGP shall be as per the existing scheme of increment on promotion from lower Pay Scale to higher Pay Scale; however, in view of the considerable raise in effective pay between the two Pay Bands, there shall be no additional increment on movement from the Pay Band of Rs. 15600-39100 to the Pay Band of Rs. 37400-67000.
(iv) All issues relating to grant of advance increments to teachers engaged in engineering/ technical courses in the university system shall be subject to recommendations of the Committee separately constituted by the Central Government for pay review of teachers in technical education.
(b) Pay ‘fixation formula’:
The pay 'fixation formula' recommended by 6th Central Pay Commission as accepted by the Central Government shall be adopted for teachers and equivalent positions in the Library and Physical Education Cadres.

Subject: Implementation Of the recommendations of the Fifth Punjab Pay Commission regarding Pension and other retirement benefits.

Sir/Madam

I am directed to invite a reference to the subject cited above and to say that after careful consideration of the recommendations of the Fifth Punjab Pay Commission, the Governor of Punjab is pleased to revise/modify/grant various benefits to the pensioners of the State as indicated in the succeeding paragraphs

DATE OF EFFECT
1.The revised provisions as per these orders shall apply to Govt. employees who retire/die in harness on or after 1st January, 2006 (separate orders are being issued in respect of employees who retired/died before 1st January, 2006). Where pension/family pension/gratuity/commutation of pension etc has already been sanctioned in cases occurring on or after 1-1-2006, the same shall be revised in terms of these orders. In cases where pension has been finally sanctioned on the pre-revised orders and if it happens to be more beneficial than the pension becoming due under these orders, the pension already sanctioned shall not be revised to the disadvantage of the pensioner in view of the proviso to the rule 9.15(1) of Punjab Civil Services Vol-II.

2.EMOLUMENTS, AND AVERAGE EMOLUMENTS

2.1 The term ‘Emoluments’ for the purposes of calculating various Pensionary benefits other than the death-cum-retirement gratuity shall mean pay as defined in rule 6.19.6 of Punjab Civil Services Rules Volume II as amended from time to time and as applicable to pensioners/family pensioners under the rules.
2.2 Basic Pay in the revised structure means pay drawn in the prescribed pay band plus applicable grade pay but does not include any other type of pay like special pay etc.
2.3 In the case of all kinds of gratuity, dearness allowance admissible on the date of retirement/death shall continue to be treated as emoluments along with the emoluments as defined in paragraph 2.1 above.
2.4 The average emoluments of those employees who retire within ten months from the date of coming over to the revised pay structure shall be calculated as follows:-
(i) For the period during which pay is drawn in pre-revised scales, Basic Pay, personal pay if any, and NPA, DA actually admissible as on 31-12-2005 in the unrevised scale.
(ii) For the period during which pay is drawn in the Revised pay structure, Basic Pay plus grade pay and NPA in the revised pay structure scales
according to the Punjab Civil Services Rules (Revised Pay) Rules, 2009. Such employees are to give an option to have their pension computed on the basis of their pre-revised reckonable emoluments in the manner as if they retired on 31st December 2005(ignoring the revised emoluments drawn by them after 1st January 2006) and have such pension consolidated and updated to 1st January 2006 level. They shall be allowed such updated pension if it is more beneficial with effect from the date of their actual retirement. Such option shall be exercised within three months of the issue of these orders; such option may be given by eligible legal heir in case of a deceased employee

3.PENSIONS

3.1 Pension shall continue to be 50% of basic pay (plus NPA). It shall also continue to be calculated on the basis of last pay drawn or 10 months average whichever is beneficial to the employees subject to the minimum of Rs 3500/- per month.
3.2 A Government employee retiring in accordance with Punjab Civil Services Rules Vol-II as amended from time to time and as applicable to the pensioners/family pensioners, before completing qualifying service of ten years shall not be entitled to pension but he shall continue to be entitled to service gratuity in terms of rule 6.16 of Punjab Civil Service Rules Vol-II.
3.3 The amount of pension shall be subject to a minimum of Rs 3500/- with effect from 1st January 2006.
Additional pension/family pension.
3.4 In addition to above provisions, the quantum of pension available to the old pensioners/family pensioners, shall be increased as follows:-

Age of pensioner/family pensioner : Additional quantum of pension/family pension
From 65 years to less than 75 years : 5% of revised basic pension/family pension
From 75 years to less than 80 years : 10% of revised basic pension/family pension
From 80 years to less than 85 years : 20% of revised basic pension/family pension
From 85 years to less than 90 years : 30% of revised basic pension/family pension
From 90 years to less than 95 years : 40% of revised basic pension/family pension
From 95 years to less than 100 years : 50% of revised basic pension/family pension
100 years or more : 100% of revised basic pension/family pension
Note:
(i) The Additional quantum of pension/family pension on attaining the age of 65 years and above would be admissible from the first day of the month in which his date of birth falls. For example, if a pensioner/family pensioner completes the age of 80 years in the month of August, 2008 he will be entitled to additional pension/family pension with effect from 1st August, 2008. Those pensioners/family pensioners whose date of birth is 1st August will also be entitled to additional pension/family pension with effect from 1st August, 2008 on attaining the age of 80 and above.
(ii)The Accountant General (A&E), Punjab shall ensure that the date of birth and the age of the pensioners/family pensioners is invariably indicated in the PEN-1 and the Pension Payment Order to facilitate payment of additional pension/family pension by the Pension Disbursing Authority as soon as it becomes due. The amount of additional pension/family pension will be
shown distinctly in the Pension Payment Order. For example, in case where a pensioner is more than 65 years of age and his pension is Rs 10,000 PM, the pension will be shown as (i) Basic Pension= Rs 10,000 and (ii) Additional Pension = Rs 500 per month. The pension on his attaining the age of 75 will be shown as (i) Basic Pension = Rs 10,000 and (ii) Additional Pension = Rs 1000 per month.
(iii)The existing provisions relating to grant of Dearness Relief on Old Age Allowance which has been termed as additional pension/family pension shall continue to be in force.

4. Rates of Retirement-cum death gratuity/DCRG

The maximum limit of Retirement-cum-Death gratuity is raised from Rs 3.50 lacs to Rs 10.00 lacs.

5. Rates of Family Pension

5.1 Family pension shall continue to be calculated at the existing rates subject to the minimum of Rs 3500/- per month.
5.2 The grant of special pension under the extraordinary pension rules is being considered separately.
5.3 For the purpose of rule 6.17 of Punjab Civil Services Rules Vol-II the existing provision/instructions shall remain to be in force.
5.4 Parents who were dependent on the Government employee when he/she was alive provided the deceased employee had left behind neither a widow nor a child. The parents whose total income from all sources was Rs 3500/- per mensem or more at the time of death of the employee shall not be considered to be dependent.

6. Commutation of Pension

6.1 A Government employee shall continue to be entitled to commute for a lump-sum payment up to 40% of his pension.
6.2 The existing Table of commutation value for pension annexed to the existing rule shall be substituted by a new table at Annexure 1 of this order.
6.3 The revised table of commutation value for pension will be used for all commutation of pension, which became absolute after the date of issue of this order. In case of such pensioners whose case for commutation became absolute on 1st January 2006 but before the issue of this order he pre-revised table of commutation of value for pension will be used for payment of commutation on pension based on pre-revised pay/pension. Such pensioner shall have an option to commute the amount of retrospective revision of pay/pension. On exercising such an option by pensioner, the revised table of commutation value for pension will be used for commutation of additional amount of pension.

7. Constant Attendant Allowance

A Constant Attendant Allowance @ Rs 3000 per month shall be given to the Punjab Government Employees who suffer 100% disability as a result of action against extremists or anti-social elements and who are dependent on somebody for day to day functions. This shall be in addition to the extra ordinary disability pension and other benefits.

8.
Ex-gratia payment

The maximum limit of ex-gratia is increased to Rs. 8.00 lacs in case of death in harness which occurs due to causes attributable to the service and Rs. 10.00 lacs for death in the case of performance of duty such as dealing riots, terrorist attack or enemy action.

9. TRAVEL CONCESSION

The existing provisions relating to the Travel Concession shall continue to be in force.

10. The pension/ family pension in terms of these orders will qualify for dearness relief beyond average All India Consumer Price Index-536 (Basic year 1982-100). The revised pattern of Dearness relief will be notified separately.

11. In respect of matters not provided in the above orders, the existing rules/instructions on the subject shall continue to be in force. The Punjab Civil Services (Revision of Pay) Rules, 2009 shall also apply, wherever required in the context of above orders. The relevant provisions of Punjab Civil Services Rules Vol-II shall deemed to have been amended to the extent of the contents of this letter, and notification for the same will be issued in due course.

12. All proposed increases in allowances and other benefits (such as old age allowance, medical allowance, constant attendant allowance, ex-gratia payment) shall be from the date of issue of these orders by the Government whereas the revised pensionary benefits (such as basic pension, commutation of pension, gratuity) shall be from 1.1.2006. Decision about payment of arrears of pensions from 1-1-2006 to 31-7-2009 shall be taken in due course of time and with effect from 1-8-2009 enhanced pension in cash shall become payable.

13. Punjabi Version of these orders will follow in due course of time.

Sir/Madam

I am directed to invite a reference to the subject cited above and to say that after careful consideration of the recommendations of the Fifth Punjab Pay Commission in respect of pensionary benefits to pre 01-01-2006 pensioners, the Governor of Punjab is pleased to rationalize the pension of pre 01-01-2006 pensioners, family pensioners, and recipients of extra ordinary pension as indicated in the succeeding paragraphs, with effect from 01-01-2006.

2 These orders will apply to pensioners/family pensioners /recipients of extra ordinary pension who were drawing pension/family pension on 01-01-2006, including those who became entitled to pension/family pension w. e. f. 01-01-2006 under the Punjab Civil Services Rules Vol-II as amended from time to time.

3 In these orders

(a) Existing pensioner/family pensioner means a pensioner who was obtaining/entitled to pension/family pension on the 1st January, 2006 consequent to retirement/death as Govt. Employee on or before 31st
December, 2005 in terms of the provisions of the Punjab Civil Services Rules Vol-II as amended from time to time.
(b) Existing Pension/family pension means the basic pension (inclusive of commuted pension, if any), due on 31-12-2005 and includes extra ordinary pension.

4.1 The pension/family pension of existing pre 01-01-2006 pensioners/ family pensioners will be consolidated w.e.f. 01-01-2006 by adding together:

I Existing pension/family pension
II Dearness Pension, where applicable.
III Dearness Relief up to AICP (IW) average index 536 (Base Year 1982–100) i.e. @ 24% of the Basic Pension/Family Pension plus Dearness Pension as admissible
IV Fitment weightage @ 40% of the existing pension/family pension.

Where the existing pension in (I) above includes the effect of merger of 50% of dearness relief w.e.f. 01-04-2004, the existing pension for the purpose of fitment weightage will be recalculated after excluding the merged dearness relief of 50% from the pension.

The amount so arrived at will be regarded as consolidated pension/family pension w.e.f. 01-01-2006 and will be noted as basic pension for the purpose of grant of Dearness relief from 01-01-2006.

4.2 The fixation of pension will be subject to the provision that the revised pension, in no case, shall be lower than fifty percent of the minimum of the pay in the pay band plus grade pay corresponding to the pre-revised pay scale from which the pensioner had retired. This will be reduced pro-rata if the qualifying service of the person falls short of 33 years.

4.3 Since the Consolidated pension will be inclusive of commuted portion of pension, if any, the commuted portion will be deducted from the said amount while making monthly disbursement.

5 In addition to the above provisions, the quantum of pension available to the old pensioners/family pensioners will be increased as follows:

Age of pensioner/family pensioner : Additional quantum of pension/family pension

From 65 years to less than 75 years : 5% of revised basic pension/family pension
From 75 years to less than 80 years : 10% of revised basic pension/family pension
From 80 years to less than 85 years : 20% of revised basic pension/family pension
From 85 years to less than 90 years : 30% of revised basic pension/family pension
From 90 years to less than 95 years : 40% of revised basic pension/family pension
From 95 years to less than 100 years : 50% of revised basic pension/family pension
100 years or more : 100% of revised basic pension/family pension

Note:
(i)The Additional quantum of pension/family pension on attaining the age of 65 years and above would be admissible from the first day of the month in which his date of birth falls. For example, if a pensioner/family pensioner completes the age of 80 years in the month of August, 2008 he will be entitled to additional pension/family pension with effect from 1st August, 2008. (ii) Proposed increase in old age allowance on attaining the age of 80 years and above shall take effect from the date of issue of these orders.
(iii) The Accountant General (A&E), Punjab shall ensure that the date of birth and the age of the pensioners/family pensioners is invariably indicated in the PEN-1 and the Pension Payment Order to facilitate payment of additional pension/family pension by the Pension Disbursing Authority as soon as it becomes due. The amount of additional pension/family pension will be shown distinctly in the Pension Payment Order. For example, in case where a pensioner is more than 65 years of age and his pension is Rs 10,000 PM, the pension will be shown as (i) Basic Pension= Rs 10,000 and (ii) Additional Pension = Rs 500 per month. The pension on his attaining the age of 75 will be shown as (i) Basic Pension = Rs 10,000 and (ii) Additional Pension = Rs 1000 per month.

6 The existing provisions relating to the Travel Concession shall continue to be in force.

7 The pension/family pension as consolidated shall be subject to a minimum of Rs 3500/- PM w.e.f. 01-01-2006.

8 Since the consolidated pension/family pension arrived at as per Para 4.1 & 7 includes dearness relief up to average index level 536 (base year 1982—100) dearness relief will be admissible thereon only beyond index average 536 (base year 1982—100) in accordance with the revised scheme of dearness relief. The six instalments of dearness relief sanctioned after 1.1.2006, i.e. w.e.f. 1.7.2006. 1.1.2007, 1.7.2007, 1.1.2008, 1.7.2008. 1.1.2009 shall be adjusted against revised dearness relief becoming due on pension/family pension as worked out on 1st January, 2006.

9 (1) Where the consolidated pension/family pension in term of Para 4.1 above works out to an amount less than Rs 3500/- the same shall be brought to Rs 3500/-. This will be regarded as pension/family pension with effect from 1st January 2006.

(2) In case a person is in receipt of pension as well as family pension, the floor ceiling of Rs 3500/- shall apply individually to such pension and family pension.

(3) The employed/re-employed pensioners/family pensioners are not getting dearness relief on pension at present. In their case the notional dearness relief which would have been admissible to them but for their employment/re-employment will be taken into account for consolidation of their pension in terms of Paragraph 4.1 above as if they were drawing the dearness relief. Their pension will be refixed w.e.f. 1.1.2006 with reference to consolidated pension becoming admissible to them. Dearness relief beyond 1.1.2006 will, however, not be admissible to them during the period of employment/re-employment.

10 The case of Punjab Govt. employees who have been permanently absorbed in public sector undertaking/autonomous bodies will be regarded as follows:

(a) Pension

Where the Government employees on permanent absorption in public sector undertakings/autonomous bodies continue to draw pension separately from the Government, the pension of such absorbees will be updated in terms of these orders. In cases where the Government employees have drawn lump-sum terminal benefits equal to 100% of their pension and have become entitled to the restoration of one third commuted portion of pension as per Supreme Court Judgement dated 15.12.1995, their cases will not be covered by these orders.

(b)Family Pension

In cases where, on permanent absorption in public sector undertakings, autonomous bodies, the terms of absorption permit grant of family pension under Punjab Civil Services Rules Vol II, the family pension being drawn by family pensioners will be updated in accordance with these orders.

11 All Pension Disbursing Authorities handling disbursement of pension to the Punjab Government pensioners/family pensioners are hereby authorised to pay pension/family pension to the existing pensioners/family pensioners.

12 It is not unlikely that the arrears due in some cases may be calculated incorrectly leading to over payment that might have to recovered subsequently. The Pension Disbursing Authorities should, therefore make it clear to the pensioners/family pensioners while drawing arrears that the payment are being made subject to adjustments from amounts that may be due to them, if any, discrepancies is noticed later. For this purpose an undertaking should also be obtained in writing from every pensioners /Family pension to the effect that excess payment that may be found to have made as a result of incorrect consolidation of pension/Family pension, the said amount will be refunded by him to the Government either by adjustment against future payment or otherwise a specimen from the undertaking is also enclosed as annexure III.

13 In respect of matters not provided in the above order, the existing rules /instructions on the subject shall continue to be in force. The Punjab Civil Services Revised Pay Rules, 2009 shall also apply, wherever required in the context of above orders. The relevant provisions of Punjab Civil services Rules Volume II shall be deemed to have been amended to the extent of the contents of this letter, and a notification for the same will be issued in due course.

14 Decision about the payment of arrears of pensioners from 1.1.2006 to 31.07.2009 shall be taken in due course of time and with effect from 1.08.2009 enhanced pension in cash shall become payable.

15 Punjabi Version of these orders will follow in due course of time.

In exercise of the powers conferred by the proviso to Article 309 read with clause (3) of Article 187 of the Constitution of India, the Governor of Punjab, after consultation with the Speaker of the Punjab Vidhan Sabha, in so far as such consultation is necessary, in terms of the provisions of clause (3) of the said Article 187, is pleased to make the following rules, namely:-

RULES

1. Short title and commencement.- (1) These rules may be called the Punjab Civil Services (Revised Pay) Rules, 2009.
(2) They shall be deemed to have come into force on and with effect from the first day of January, 2006.

2. Application. - (1) Save as otherwise expressly provided by or under these rules, they shall apply to all the persons appointed to the services and posts in connection with the affairs of the State of Punjab and staff of Punjab Vidhan Sabha Secretariat provided that the staff of Punjab Vidhan Sabha will get pay/ allowances and other benefits at par with the staff of Punjab Civil Secretariat as per provisions of Rule 14 of Punjab Vidhan Sabha Secretariat Service Rules, 2007.

(2) They shall not apply to the: -
(a) members of the All India Services serving in connection with the affairs of the State of Punjab;
(b) persons not in the whole-time employment of the Government of Punjab;
(c) persons paid out of contingencies;
(d) employees whose scales of pay have been determined on the recommendations of the University Grants Commission;
(e) persons employed on contract basis, except when the contract provides otherwise; and
(f) persons specifically excluded wholly or in part from the operation of these rules.

3. Definitions: - In these rules, unless there is anything repugnant in the subject or context ;
(a) ”existing basic pay” or “pre-revised basic pay” means the pay drawn in the prescribed existing/pre-revised scale of pay including ex-gratia annual increment(s), but does not include any other type of pay like ‘special pay’, etc;
(b) “existing scale” or “pre-revised scale” in relation to a Government employee means the scale in respect of a post held or higher scale granted under the Assured Career Progression Scheme to him or, as the case may be, personal scale allowed to him on the first day of January, 2006, whether in a substantive or officiating capacity;
Explanation. - In the case of a Government employee, who was on the first day of January, 2006, on deputation out of India or on leave or on foreign service, or who would have on that date officiated in one or more lower posts, but for his officiating in a higher post, “existing scale” shall include the scale applicable to the post which he would have held, but for his being on deputation out of India or on leave or on foreign service or, as the case may be, but for his officiating in a higher post;
(c) “existing emoluments” means the sum of ;
(i) basic pay in the existing scale as on the first day of January, 2006 or on the date of option under rule 6;
(ii) dearness pay appropriate to the existing basic pay;
(iii) interim relief calculated at the rate of five per cent of the existing basic pay plus dearness pay; and
(iv) dearness allowance appropriate to the existing basic pay plus dearness pay plus interim relief.
(d) “Fitment Table” means the relevant fitment table attached to these rules showing revised pay structure corresponding to a particular pre-revised pay scale;
(e) “Government” means the Government of Punjab in the Department of Finance;
(f) “pay in the pay band” means the pay drawn in the running pay bands specified in column 6 of the Schedule;
(g) “grade pay” means the fixed amount corresponding to the pre-revised pay scales or posts specified in column 7 of the Schedule.
(h) “revised pay structure” in relation to any post or pre- revised scale specified in column 3 of the Schedule, means the pay band and grade pay, as specified against that post or pre-revised pay scale in columns 6 and 7 thereof, unless a different revised pay band and grade pay or pay scale is notified separately for the post;
(i) “basic pay” in the revised pay structure means the pay drawn in the specified pay band plus the applicable grade pay, but does not include any other type of pay like special pay etc.;
(j) “revised emoluments” means the pay in the pay band plus the grade pay of a Government employee in the revised pay structure and includes dearness allowance; and
(k) “Schedule” means a Schedule, appended to these rules providing for a General Conversion Table for revised pay structure and grouping applicable in relation to the corresponding unrevised pay scale of the employees.

4. Scale of pay of posts. — The corresponding pay band and grade pay as applicable, to every post or pre-revised scale, specified in the Schedule, shall be, as shown therein against each post or pre-revised scale.

5. Drawal of pay in the revised pay structure. — Save as otherwise provided in these rules, a Government employee shall draw pay in the revised pay structure applicable to the post to which he is appointed:
Provided that a Government employee may opt to continue to draw pay in the existing scale, until the date on which he earns his next or any subsequent increment in the existing scale or until he vacates his post or ceases to draw pay in that scale;
Provided further that in cases where a Government employee has been placed in higher pay scale between 1.1.2006 and the date of notification of these Rules on account of promotion, upgradation of pay scale under the Assured Carrier Progression Scheme or otherwise, the Government employee may elect to switch over to the revised pay structure from the date of such promotion, upgradation etc.
Provided further that in case where a Government employee has been placed in higher pay scale under the un-revised pay scales between 1.1.2006 and the date of notification of these rules on account of promotion or progression under the Assured Career Scheme, the pay of the government employee on the date of grant of such higher scale shall be regulated in such a manner that his corresponding revised pay in the revised pay structure is not lower than that shown in the Fitment Table, applicable to such pre-revised higher scale.
Explanation I - The option to retain the existing scale under the first and second provisos to this rule shall be admissible only in respect of one existing scale.
Explanation 2 - The aforesaid option shall not be admissible to a person, appointed to a post on or after the first day of January, 2006, whether for the first time in Government service or by transfer from another post and he shall be allowed pay only in the revised pay structure.

6. Exercise of option - (1) The option under the provisos to rule 5, shall be exercised in writing in the form appended to these rules so as to reach the authority specified in sub-rule (2) within a period of three months from the date of publication of these rules or where an existing scale has been further revised by any order made subsequent to that date, within a period of three months from the date of such order: -
Provided that ;
(i) in the case of a Government employee, who on the date of such publication or as the case may be, on the date of such order, is out of India on leave or on deputation or on foreign service or on active service, the option shall be exercised in writing so as to reach the said authority within a period of three months from the date of his taking the charge of his post under the State Government; and
(ii) where a Government employee is under suspension on the first day of January, 2006, the option may be exercised within a period of three months from the date of his return to his duty, if that date is later than the date specified in this sub-rule.
(2) The option shall be intimated by the Government employee to the Head of his Office.
(3) If the intimation regarding option is not received within the period as specified in sub-rule (1), the Government employee shall be deemed to have elected to be governed by the revised pay structure with effect from the first day of January, 2006.
(4) The option once exercised shall be final.
Note 1. Persons, whose services were terminated on or after the first day of January, 2006 and who could not exercise their option within the specified period, on account of discharge on the expiry of the sanctioned posts, resignation, dismissal or discharge or disciplinary grounds, are entitled to the benefits admissible of this rule.
Note 2. Persons, who have died on or after the first day of January, 2006 and could not exercise their option within the specified period shall be deemed to have opted for the revised pay structure on and from the first day of January, 2006 or such later date as is most beneficial to their dependents, if the revised pay structure is more favourable and in such cases, necessary action for payment of arrears should be taken by the Head of Office.
Note 3. Persons, who were on earned leave or any other leave on 1.1.2006, which entitled them to leave salary, shall be allowed the benefits admissible under this rule.

7. Fixation of pay in the revised pay structure - The pay of a Government employee, who opts or is deemed to have opted under sub-rule (3) of rule 6 to be governed by the revised pay structure in terms of the provisions of these rules, shall, unless in any case, the Government by special order otherwise directs, be fixed in the following manner, namely: -
(i) the basic pay in the revised pay structure will be fixed with reference to the existing basic pay in the pre-revised pay scale of the post including higher scale granted under the Assured Career Progression Scheme as on 01.01.2006 or thereafter, as the case may be, and shall be an amount equal to the sum of the ‘pay in the pay band’ and ‘grade pay’ as shown in column 4 of the Fitment Table applicable to the relevant post or pre-revised pay scale;
(ii)
in case of employees, who are getting ex-gratia increments on the date of option, the revised basic pay shall be determined by multiplying the existing basic pay with 1.86 rounded off to the next higher ten and adding Grade Pay as given in the applicable Fitment Table;
(iii) an employee, who reaches at the maximum of the Pay Band, shall be placed in the higher pay band after one year without any change in the Grade Pay; and
(iv) in the case of a Government employee, who is in receipt of Special Pay, Family Planning Allowance, Special Allowance or Non-Practising Allowance (NPA) or by whatever name it may be called at the same rate or at different rates, such a Government employee shall draw Special Pay, Family Planning Allowance, Special Allowance or Non-Practising Allowance at the rate, allowed with the revised scale. In such cases, the allowance at the new rate shall be drawn in addition to pay in the revised pay structure from the date specified in the individual notifications relating to these allowances.
Note 1. Where the increment of a Government employee falls on the first day of January, 2006 he shall have the option to draw the increment in the existing scale or in the revised Pay Band.
Note 2. A Government employee, who is on leave on the first day of January, 2006, and is entitled to leave salary, shall become entitled to pay in the revised pay structure from 1.1.2006 or the date of option for the revised pay structure.
Note 3. A Government employee, under suspension, shall continue to draw subsistence allowance based on existing scale of pay and his pay in the revised pay structure will be subject to the final order on the pending disciplinary proceedings.
Note 4. Where the existing emoluments exceed the revised emoluments in the case of any Government employee, the difference shall be allowed as personal pay to be absorbed in future increases in pay.
Note 5. Where in the fixation of pay under this rule, a Government employee, who, in the existing scale was drawing immediately before the first day of January 2006, more pay than another Government employee junior to him in the same cadre, gets his pay fixed in the revised pay band at a stage lower than that of such junior, his pay shall be stepped up to the same stage in the revised pay band as that of the junior.
Note 6. In case where a senior Government employee promoted to a higher post before the first day of January, 2006 draws less pay in the revised pay structure than his junior, who is promoted to a higher post on or after the first day of January, 2006, the pay in the pay band of the senior Government employee will be stepped up to an amount equal to the pay in the pay band as fixed for his junior in that higher post. The stepping up will be done with effect from the date of promotion of the junior Government employee subject to the fulfillment of the following conditions, namely: -
(a) both the junior and the senior Government employees should belong to the same cadre and the posts in which they have been promoted should be identical in the same cadre;
(b) the pre-revised scale of pay and the revised grade pay of the lower and higher posts in which they are entitled to draw pay should be identical;
(c) the senior Government employees at the time of promotion should have been drawing equal or more pay than the junior; and
(d) the anomaly should be directly as a result of application of the provisions of these rules or any other rule or order regulating pay fixation on such promotion in the revised pay structure. If even in the lower post, the junior officer was drawing more pay in the pre-revised pay than his senior by virtue of any advance increment(s) granted to him, the provisions of this note shall not be invoked to step up the pay of the senior employee.

8. Mode of payment of arrear of pay – Notwithstanding anything contained in these rules, the arrear with effect from first January, 2006 to 31 of July 2009 will be paid in such manner and at such time as may be decided by Government. The revised pay under these rules shall be drawn from the first day of August, 2009.

9. Rate of increment in the revised pay structure. - The rate of increment in the revised pay structure will be three per cent of the sum of the pay in the pay band and grade pay applicable, which will be rounded off to the next multiple of 10. The amount of increment will be added to the existing pay in the pay band.

10. Date of next increment. - The next increment of a Government employee, whose pay has been fixed in the revised pay structure in accordance with rule 7, shall be granted on the date, he would have drawn his increment, had he continued in the existing scale:
Provided that the next increment of a Government employee whose pay is fixed on the first day of January, 2006 at the same stage as the one, fixed for another Government employee junior to him in the same cadre and drawing pay at a lower or equal stage than his senior in the existing scale, shall be granted on the same date as admissible to his junior, if the date of increment of the junior happens to be earlier.

11. Fixation of pay on promotion.
- In the case of promotion from one grade pay to another in the revised pay structure, the pay fixation will be done as follows: -
(i) one increment equal to three per cent of the sum of the pay in the pay band and the existing grade pay will be computed and rounded off to the next multiple of 10. This will be added to the existing pay in the pay band. The grade pay corresponding to the promotion post will thereafter be granted in addition to this pay in the pay band. In cases where promotion involves change in the pay band also, the same methodology will be followed. However, if the pay in the pay band after adding the increment is less than the minimum of the higher pay band to which promotion is being made, the pay in the pay band will be stepped to such minimum.

12. Illustration :- With a view to provide guidance in the fixation of pay under the relevant rules of these rules, illustrations 1 to 5 have been given, which are appended to these rules.


13. Overriding effect
- The provisions of the Punjab Civil Services Rules, Volume I, Part I and the Punjab Civil Services Rules, Volume II, the Punjab Civil Services (Revised Scales of Pay) Rules, 1979 the Punjab Civil Services (Revised Pay) Rules, 1988 and the Punjab Civil Services (Revised Pay) Rules, 1998, shall not, save as otherwise provided in these rules, apply to the cases, where pay is regulated under these rules, to the extent they are inconsistent with these rules.

14. Power to relax.
- Where the Government is satisfied that the operation of these rules causes undue hardship to any individual Government employee or class of Government employees, it may, by an order in writing, relax or dispense with any of the provisions of these rules to such extent and subject to such conditions, as it may consider necessary.

15. Interpretation.
- If any question arises relating to the interpretation of any of the provisions of these rules, the Government shall decide the same.

Dearness Relief with effect from 01-01-2006

The Punjab Government has already sanctioned Dearness Relief to pensioners/family pensioners at the following rate, which is based on the recommendation of 6th Central Pay Commission and accepted by the Central Government for it pensioners/family pensioners:

Date from which payable: Rate of Dearness Relief per mensem

From 1.1.2006 : No Dearness Relief
From 1.7.2006 : 2% of basic/family pension
From 1.1.2007 : 6% of basic/family pension
From 1.7.2007 : 9% of basic/family pension
From 1.1.2008 : 12% of basic/family pension
From 1.7.2008 : 16% of basic/family pension
From 1.1.2009 : 22% of basic/family pension


Note:

Dearness Relief at the rates indicated above will also be admissible on the additional basic pension/additional family pension available to older pensioners/family pensioners based on their age.

The payment of Dearness Relief from the dates indicated above shall be made after adjusting the instalments of enhanced Dearness Relief already sanctioned and paid to Punjab Government pensioners/family pensioners with effect from 1.1.2006, 1.7.2006, 1.1.2007, 1.7.2007, 1.1.2008, 1.7.2008, 1.1.2009 as per previous orders.

Subject: Implementation of the recommendations of the Fifth Punjab Pay Commission – Dearness Allowance to the employees of Punjab Government.

Sir,
I am directed to address you on the subject cited above and to say that consequent upon the decision taken by the Government and notified through Punjab Civil Services (Revised Pay)Rules, 2009, the Governor of Punjab is pleased to decide that the Dearness Allowance, admissible to all categories of employees of Punjab Government, who have elected to be governed or deemed to have elected to be governed or have been brought to be governed by Punjab Civil Services (Revised Pay) Rules, 2009 and as the case may be, shall be admissible from the dates mentioned below at the
following rates:-

2. The payment of Dearness Allowance under these orders from the date indicated above shall be made after adjusting the instalments of Dearness Allowance already sanctioned and paid to the concerned employees of Punjab Government with effect from 1.1.2006, vide No.3/2/97-1FP1/2718-2722, dated 10-4-2006, 1-7-2006 vide No.3/2/97-1FP1/6248-6252, dated 10-10-2006, 1-1-2007 vide No.3/2/97-1FP1/3196-3200, dated 12-4-2007, 1-7-2007, vide No.3/2/97-1FP1/7105-7109, dated 6-11-2007, 1-1-2008 vide No.3/2/97-1FP1/55-70, dated 15-7-2008. 1-7-2008 vide No.3/2/97-1FP1/299-313, dated 15-12-2008, 1-1-2009 vide No.3/2/97-1FP1/157-171, dated 28-4-2009.

3. The term ‘basic Pay’ in the revised pay structure means the pay drawn in the prescribed pay band plus the applicable grade pay but does not include any other type of pay like special pay etc. For the purpose of calculation of dearness allowance, non-practicing allowance where applicable shall be taken into account as at present.

4. The Dearness Allowance will continue to be a distinct element of remuneration and will not be treated as pay within the ambit of Civil Services Rules or any other relevant rules.

5. The payment on account of dearness allowance involving fraction of 50 paise and above may be rounded off to the next higher rupee and the fraction of less than 50 paise may be ignored.
